A. Cancellation policy

Introduction

Consumers have a right of withdrawal subject to the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity:

Right of cancellation

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party nominated by you, who is not the carrier, have or has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (TP-Ortho GmbH, Bergstraße 1B, 53474 Bad Neuenahr, Germany, Tel.: 02641 8970500, Email: info@tp-ortho.de) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory.

To comply with the withdrawal period, it is sufficient to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of cancellation

If you revoke this contract, we shall reimburse you for all payments received from you, including the cost of delivery (with the exception of the additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which the notification of your revocation of this contract is received by us. For this repayment, we shall use the same means of payment as you used for the original transaction, unless an express agreement with you has been reached to the contrary; under no circumstances shall you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier date.

You shall return or hand over the goods to us or to TP-Ortho GmbH, Walporzheimerstraße 30, 53474 Bad Neuenahr-Ahrweiler, Germany, without delay and in any case no later than fourteen days from the date on which you inform us of your withdrawal from this contract. The deadline is met if you dispatch the goods before the expiry of the fourteen-day period.

You will bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods if this diminished value is due to handling of the goods that was not necessary for the examination of their nature, characteristics and functioning.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal shall expire prematurely in the case of contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been broken after delivery.

The right of withdrawal shall not apply to consumers who, at the time of the conclusion of the contract, are not a member of a Member State of the European Union and whose sole place of residence and delivery address are outside the European Union at the time of the conclusion of the contract.

General information

1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage using suitable packaging.
Please do not send the goods back to us postage due.
3) Please note that the aforementioned points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
